Terms of Service

These Terms of Service ("Terms") govern your use of the CloudSingh platform and services. By creating an account or using our services, you agree to be bound by these Terms.

1. Account Creation

To use CloudSingh, you must create an account by providing a valid email address and password. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

Each account is associated with a workspace. You may invite additional users to your workspace and assign them roles with specific permissions. You are responsible for the actions of all users within your workspace.

2. Acceptable Use

You agree to use CloudSingh only for lawful purposes and in accordance with these Terms. You must not:

  • Send spam, unsolicited messages, or bulk messages to recipients who have not opted in
  • Use the platform for harassment, fraud, or any illegal activity
  • Attempt to circumvent rate limits, usage quotas, or security measures
  • Share your API keys or account credentials with unauthorized parties
  • Use the platform to send content that violates any applicable laws or regulations
  • Reverse engineer, decompile, or attempt to extract the source code of the platform

3. WhatsApp Compliance

CloudSingh operates as a platform that facilitates messaging through WhatsApp. You are responsible for complying with WhatsApp's Terms of Service, Business Policy, and Commerce Policy when using our platform.

CloudSingh includes built-in rate limiting and anti-spam features to help protect your WhatsApp account, but ultimate compliance with WhatsApp's policies is your responsibility. We are not affiliated with, endorsed by, or sponsored by WhatsApp or Meta Platforms, Inc.

4. Data Handling

You retain ownership of all data you upload to or create within CloudSingh, including contacts, message templates, and campaign data. We process your data solely to provide and improve the service.

5. Service Availability

We strive to maintain high availability of the CloudSingh platform but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify users in advance of planned maintenance. We are not liable for any losses resulting from service interruptions.

6. Plans and Billing

CloudSingh offers multiple subscription plans with different feature sets and usage limits. Plans and pricing are subject to change. Plan changes take effect as configured by your workspace administrator.

7. Termination

You may close your account at any time by contacting support. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to comply with WhatsApp's policies.

Upon termination, your access to the platform will cease. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, CloudSingh and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to CloudSingh in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The CloudSingh platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
